Villages Homes Association dismisses incorporation petition

On August 28, 2009 Castle Pines Village Homes Association filed a Motion to Withdraw Petition for Incorporation of the City of Castle Pines, which was granted by the judge.
Judge Nancy A. Hopf stated that, “The petition for incorporation [case number 2008cv251] shall hereby be withdrawn and this case closed.”
Village Homes Association president Ed Will, said, “ It was strategically better for us to retract the petition. Judges like to see you be more proactive; it is a basic courtesy to the court.” Will continued to say that, “It may be explored at some time in the future, but we [the homes association] have decided at this point not to reactivate the petition.”
Castle Pines North Mayor Maureen Shul responded to the Village’s withdrawl by stating, “While it was the Castle Pines Village’s inclusion of our commercial district into their proposed city boundaries that precipitated our community dialogue on incorporation, there is little doubt we made the right decision in becoming a city for our businesses, our smart growth, our community, and our future.”
Shul went on to state, “If the village indeed does not pursue incorporation, the revenue sharing agreement with them, which expires in less than three years, never goes into effect.”
“While we now know that other areas were also looking to include our business district within their city boundaries, the citizens of Castle Pines North made a bold move by taking control of their destiny and becoming a city,” she stated.
Shul says she looks back with gratitude that residents were forced to make this decision, because it has and will continue to provide us with the opportunities to make our quality of life and financial viability that much stronger.
